Cancellation policy/Right of cancellation

If you are acting as a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us, VibuCard SL, of your decision to withdraw from this contract by means of a clear statement (e.g., by email or post). In the event of a valid withdrawal, any payments or services received by either party must be returned, and any benefits derived (e.g., usage benefits) must be surrendered. If you have already used the contractual service in whole or in part, you must compensate us accordingly. The right of withdrawal expires prematurely if the contract has been fully performed by both parties at the customer's express request before you have exercised your right of withdrawal. This also applies if the digital profile has been created. The right of withdrawal described here does not apply to contracts with business customers or to personalized products (NFC accessories) delivered with a personal ID.

Consequences of revocation

In the event of a valid cancellation, both parties are obligated to return any goods or services received and to surrender any benefits derived from them (e.g., interest). If you are unable to return the received goods or services, or any benefits derived from them (e.g., advantages of use), either in whole or in part, or only in a deteriorated condition, you must compensate us for the lost value. You are only required to compensate us for deterioration of the goods or benefits derived from them if the deterioration or benefits are due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning. "Ascertaining the nature, characteristics, and functioning" means testing and trying out the respective goods as is possible and customary in a retail store. Goods that can be shipped by parcel post must be returned at our risk. You are responsible for the regular return shipping costs if the delivered goods match your order and if the price of the item being returned does not exceed €99.95, or if, in the case of a higher-priced item, you have not yet paid the full purchase price or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you. Refunds must be processed within 30 days. This period begins for you when you send your cancellation notice or return the item, and for us when we receive it.

Exceptions to the right of withdrawal

The right of withdrawal described here does not apply to the delivery of goods that have been manufactured according to the customer's own individual specifications (§ 312d para. 4 of the German Civil Code). This includes, for example, the selection of colors, custom logos, and items with a unique ID on the NFC chip, as these are manufactured individually on demand. Software is also excluded from the right of withdrawal once it has been used.
